June 12, 2004 … a federal judge upheld a USDA rule from the prior year declaring that “frozen, batter coated french fries are fresh vegetables,” stating that the term ‘fresh vegetables’ was ambiguous.

And, insert drumroll, in 1981, the USDA tried to classify ketchup and pickle relish as vegetables —alas, due to public protest they dropped the idea. Somewhere, a French fry is still laughing.
